Welcome to Behart. The following Terms and Conditions of Use represent an agreement between you and Behart ("we" or "our") that governs your access to and use of our website, products and services ("Services"). By accessing or using our Services in any way, you agree to these Terms and Conditions. If you do not agree to these Terms and Conditions, you are not permitted to access or use our Services. Please read the following document carefully and feel free to contact us if you have any questions or suggestions. The Privacy Policy To provide our Services, we must collect and use your information. The Privacy Policy explains how we collect, use and share information. It also explains the ways you can control their information. You must accept the Privacy Policy to use Behart. Terms User: Any person or entity who accesses or uses our Services in any way, whether or not they register for a Behart account, including you. Content: means any and all images, text, information, data, audio, video, graphics, computer code, software and other material provided through our Services, including when we send you an Email. The content includes both artistic content and user content. Works: artistic content that the artist sends and publishes from our Services, including licensed content from a third party. General Terms of Content • You should keep in mind that the Content displayed on our Services covers a wide range of visual arts, is generally not censored and may include nudes or other visual or written material that some people may consider offensive or inappropriate for children and minors. If you allow your child or any other person to use your computer or other device, it is your sole responsibility to prevent them from accessing any Content that you believe may be inappropriate for them. • Except as expressly permitted by these Terms and Conditions of use, you must not reproduce, distribute, adapt, modify, translate, create derivative Works, publish or use any Content in any way without prior written permission from us or (as applicable) third party rights holder. • Any commercial exploitation of any image or other Content is strictly prohibited without the prior written permission of us or (as applicable) of the owner of the rights of third parties, including any commercialized reproduction, distribution, publication or creation of derivative Works. User Content • Some services may allow users to send, publish or provide User Content. Each user is solely responsible for all the Content they provide in through our Services. • You acknowledge that we have no obligation to review or examine any User Content, and that by using our Services, you may be exposed to Content that is inaccurate, misleading, offensive or objectionable. Who can use Behart We want our Service to be as inclusive and open as possible, but we also want it to be safe and comply with the law. For this, it is necessary that you commit yourself to comply with some restrictions in order to be part of the Behart community. • You must be at least 18 years old or the minimum legal age in your country to use Behart. • We must not have previously disabled your account due to a violation of the law or any of our policies. • You should not be a criminal convicted of sexual crimes. Your commitments We promise to provide you with the Service, but we require you to assume the commitments indicated below. You agree that you will not (and will not attempt, or assist or encourage any other person or entity: • Send, publish or provide any User Content through our Services, or take any other action in relation to our Services (whether online or offline), that: i. infringes, misuses or violates the rights or intellectual property of any third party, including any copyright, moral right, trademark right, trade secret, patent right, privacy right, advertising right or contractual right: ii. violates (or encourages any conduct that violates) any applicable local, state or national, or international law or regulation, including any tax law, consumer protection law or law governing the export or import of data, goods, services or software ; iii. is deceptive, deceptive, fraudulent, defamatory, slanderous, abusive, harassing, discriminatory, hateful, malicious, incites violence, threatening, sexually explicit, or obscene or iv. supplants or misrepresents your relationship with any person or entity; • Create a fake or misleading Behart account or a user profile with inaccurate or false information; • Use our Services to list, market, offer for sale or sell goods or services without our prior written permission; • Use our Services or any Content in connection with the publication or distribution of spam or other unauthorized or unsolicited advertising, promotional messages or mass electronic communications; • Collect information about users (including email addresses) or send marketing emails or other promotional communications to users without their consent; • Access our Services by any means other than the interface and the instructions we provide; • Access, manipulate or use non-public areas of our Services, our computer systems or the technical delivery systems of our service providers; • Violate, disable or circumvent any security or authentication measure in or in connection with our Services; • Interfere with the normal operation of our Services or the access of any User, including the transmission of viruses or harmful codes, flood our Services with excessive requests or traffic, or take any other action that creates (in our sole discretion) an unreasonable measure or disproportionately large to load on our servers or systems; • Decipher, decompile, disassemble, reverse engineer, or derive or extract any source code or underlying ideas or algorithms from any of our Services; • Adapt, modify, create derivative works or redistribute any of our Services without our prior written permission; • Use any robot, scraper, spider or other automatic or manual process to monitor or extract data from our Services without our prior written permission (we can also use robot exclusion headers within our Services and you agree to comply with all those headers) ; • Forge any TCP / IP packet header or any part of the header information in any email or publication, or in any way use our Services or any Content to send altered, misleading or false source identification information; • Duplicate, frame or display any part of our Services on any other website or anywhere else without our prior written permission; • Use meta-tags or other hidden text or metadata containing any registered trademark, service mark, product name or Behart URL without our prior written permission; • Use any registered trademark, service mark, product name, logo or URL of Behart in any way that incorrectly suggests our affiliation or endorsement of any person, entity, event, product or service; • Remove, hide, modify or alter any copyright, trademark or other trademark or notice of ownership, or any digital watermark or other technical measure used to indicate the source or ownership of any image or other Content. Permissions you grant us As part of our agreement, you also grant us the permissions we need to provide you with the Service. • We do not claim ownership of your Content, but you grant us a license to use it. Nothing changes regarding your rights to your Content. We do not claim ownership of the Content you post on or through Behart. Instead, when you share, publish or upload Content that is protected by intellectual property rights (such as photos or videos) in our Service, or in connection with it, you hereby grant us an international, transferable, free license royalties and not exclusive to host, use, distribute, modify, manage, copy, display or publicly display and translate your Content, as well as to create derivative works from it (in accordance with your privacy and application settings). You may delete the Content or your account at any time to terminate this license. However, the Content will continue to appear if you shared it with others and they did not delete it. For more information on how we use the information and how to control or delete your Content, review our Privacy Policy. • You agree that we can download and install updates to the Service on your device. Additional rights we reserve • If you select a username or similar identifier for your account, we can change it if we consider it appropriate or necessary. For example, if it infringes the intellectual property rights of another person or impersonates the identity of another user. • If you use copyrighted content that we own and include in our Service, such as images or photography we offer and that you add to the Content you create or share, we reserve all rights to such Content, but not yours. • You can only use our intellectual property and trademarks or any similar brand with our prior written permission. • You must obtain our written permission or a permit under an open source license to modify, decompile or otherwise attempt to extract our open source, or to create derivative works from it. Removal of Content and disabling or canceling the account • We may remove any Content or information that you share on Behart if we believe that it violates these Terms and Conditions of use, our policies or if the law requires it or allows us. We may refuse to provide or stop providing you with all or part of the Service (including canceling or disabling your account) immediately to protect our community or our services, or if you pose a risk or legal exposure to us, you repeatedly infringe the rights of Author of other people, or the law requires it or allows us. If we take steps to disable or cancel your account, we will notify you when appropriate. If you believe that your account was canceled by mistake or you want to disable or permanently delete it, contact us. • The Content you delete may continue to appear for a limited time in backup copies and will remain visible where others have shared it. Update of these Conditions We may make changes to our Service or policies and this implies that we must update these Terms and Conditions of use. We will send you a notification (for example, through our Service) before modifying these Terms and Conditions, and we will give you the opportunity to review the changes before they take effect. If you decide to continue using the Service, you will be subject to the updates made. If you do not want to accept these or other updated Terms and Conditions, you can delete your account.
